Bathing and Spa Regulations

Dear Guests!

By purchasing an online ticket, obtaining an admission device (chip) and visiting the thermal bath and spa, you enter into a contract with Therme Wien GmbH & Co KG governing your visit to the thermal bath and spa and thereby accept the following Bathing Regulations as part of that contract.

It is mutually agreed that guests are obliged to pay, among other things, admission charges, charges for food and beverages, any additional services used, reimbursement of any expenses incurred and compensation for any damage caused.


1.1. Use of the Facilities and Risks Borne by Guests

(1) Therme Wien GmbH & Co KG allows its guests to use the facilities of the thermal bath and spa in accordance with these Bathing Regulations and at their own risk.

(2) Neither Therme Wien GmbH & Co KG nor its staff can prevent bathing accidents in all circumstances. In particular, guests themselves bear the risks associated with the activities they undertake on the premises of the thermal bath and spa.

(3) The same applies to injuries and other infringements of a guest’s personal rights caused by other guests or by third parties who are not members of staff of Therme Wien GmbH & Co KG.

(4) Therme Wien GmbH & Co KG therefore assumes only the following obligations towards its guests:

1.2. Opening Hours and Admission

(1) Therme Wien GmbH & Co KG is obliged to allow guests to visit during the opening hours announced by notices or by the supervisory staff.

(2) If the officially permitted maximum number of visitors is exceeded, Therme Wien GmbH & Co KG must, with the assistance of the responsible staff, refuse admission to further visitors. In such cases, prospective visitors must expect waiting times.

(3) Therme Wien GmbH & Co KG reserves the right to refuse admission, without giving reasons, to any person whose admission to the thermal bath and spa is considered inappropriate.

1.3. Condition and Operation of the Facilities

(1) Therme Wien GmbH & Co KG is responsible for ensuring that the facilities are constructed, operated and maintained in accordance with the applicable regulations. In particular, Therme Wien GmbH & Co KG must comply with all applicable hygiene and safety regulations. No further obligations apply.

(2) As soon as Therme Wien GmbH & Co KG becomes aware of any malfunction, defect or damage to a facility that means its safe operation can no longer be guaranteed, it will immediately prohibit use of the affected facility or appropriately restrict its use.

(3) In such a case, as well as where one or more facilities are closed for inspection or maintenance work, it is agreed that there is no entitlement to a reduction in the admission charge.

(4) Each guest is responsible for complying with the instructions of the responsible staff.

1.4. Monitoring Compliance with the Bathing Regulations

Therme Wien GmbH & Co KG will, within reasonable limits and with the assistance of its responsible staff, monitor compliance with the Bathing Regulations by guests and other persons present on the premises. If conduct contrary to these regulations is identified, the persons concerned will be warned and, where necessary, required to leave the premises. In such cases, there is no entitlement to a refund of the admission charge. In the event of immoral or indecent conduct or damage to property, an expense charge of up to € 150 will be imposed.

1.5. Assistance in the Event of Accidents

If an accident occurs, Therme Wien GmbH & Co KG will, with the assistance of its responsible staff and within reasonable limits, immediately take appropriate measures to provide assistance.

1.6. Assistance in Preventing Reported Dangers

If guests credibly report to Therme Wien GmbH & Co KG, and in particular to its responsible staff, an imminent danger to the health or life of guests, Therme Wien GmbH & Co KG will, with the assistance of its staff and within reasonable limits, endeavour to avert that danger.

1.7. No Ability to Supervise Minors, Persons Lacking Legal Capacity, Persons with Disabilities and Non-Swimmers

Therme Wien GmbH & Co KG and its staff are not able, and are therefore not obliged, to supervise minors, persons lacking legal capacity, persons with physical or mental disabilities or non-swimmers.

1.8. Liability of Therme Wien GmbH & Co KG

(1) Therme Wien GmbH & Co KG is liable only for damage caused to a guest by Therme Wien GmbH & Co KG or its staff through unlawful, in particular contractual, and culpable conduct.

(2) Therme Wien GmbH & Co KG is not liable for damage caused by failure to comply with the Bathing Regulations or any other rules of use, failure to follow the instructions of the responsible staff, any other fault on the part of the injured person, or unavoidable events or force majeure, including in particular acts by third parties. Contributory fault will result in a corresponding apportionment of the damage. The same applies accordingly to any special rules of use displayed at the respective equipment and facilities (e.g. waterslides, diving platforms, sauna, solariums, etc.) and to any prohibitions or restrictions on use within the meaning of Section 1.3. (2).

(3) Parking areas are used at the guest’s own risk. Therme Wien GmbH & Co KG is neither obliged to supervise parking areas nor to maintain their surfaces or other facilities for the purpose of protecting vehicles against damage (e.g. from nails, broken glass or potholes on the surfaces). Use of the car park is also subject to the provisions of the Therme Wien Car Park Regulations, which are displayed at the entrance and in the areas containing the payment machines.


2. Obligations of Guests

2.1. Admission Tickets, Chip Wristbands, Keys and Charges

(1) The thermal bath and spa may only be used with a valid admission device (chip) in accordance with the Schedule of Charges. The Schedule of Charges forms part of the Bathing Regulations.

(2) Guests found in the thermal bath and spa without valid authorisation for admission (admission device) must pay three times the applicable daily admission charge.

(3) The admission device (chip key) must be returned when leaving the thermal bath and spa.

(4) Compensation must be paid for lost admission devices (as stated in the notices displayed).

2.2. Supervision of Children, Minors, Non-Swimmers and Persons with Disabilities

(1) Persons who otherwise have a duty to supervise children, minors, non-swimmers and persons with physical or mental disabilities (e.g. parents or legal guardians or appropriate supervisory or care staff) must ensure that adequate supervision is provided.

(2) These persons responsible for supervision remain responsible even if they do not enter the premises of the thermal bath and spa or leave the premises before the persons under their supervision.

(3) Children under the age of 14 may only enter when accompanied by an (authorised) supervising person who is at least 14 years old. Therme Wien GmbH & Co KG is not obliged to verify a statement by an accompanying person that they are authorised to provide supervision and may rely on the accuracy of such a statement. However, where appropriate, Therme Wien GmbH & Co KG is entitled to reject a supervising person who is clearly unsuitable. By declaring that they are authorised or willing to provide supervision, the accompanying person assumes responsibility for that supervision. The supervising person is fully responsible for the conduct of the children accompanying them while in the thermal bath and spa and for ensuring compliance with the Bathing Regulations. If persons nevertheless enter the thermal bath and spa contrary to these provisions, the other persons who have a duty of supervision (e.g. parents or legal guardians) remain fully responsible.

(4) The applicable youth protection regulations, in particular prohibitions concerning alcohol and smoking, restrictions on presence and the obligations of parents or legal guardians, must be observed by young people and their parents or legal guardians.

2.3. Supervision of Group Visits

(1) In the case of group visits, the responsible supervising person in the case of school pupils, and the responsible representative in the case of clubs and other organisations, must ensure compliance with the Bathing Regulations and bears full responsibility for doing so. The group’s own supervising persons must be present throughout the entire group visit.

(2) These supervising persons must maintain appropriate coordination with the supervisory staff of the thermal bath and spa to ensure that the normal operation of the thermal bath and spa and the experience of other guests are not disrupted by the group visit.

2.4. Instructions from Thermal Bath and Spa Staff

(1) Guests are obliged to follow the instructions of the responsible thermal bath and spa staff without exception. This also applies if a guest believes that an instruction given to them is not justified.

(2) Anyone who breaches the Bathing Regulations, prohibitions on the use of specific facilities (e.g. waterslides, diving platforms, sauna, solariums) or restrictions within the meaning of Section 1.3. (2), or who refuses to follow the instructions of the responsible staff, may be required by such staff or another representative of the thermal bath and spa to leave the premises without any entitlement to a refund of the admission charge. Any charges for food, beverages or other consumption incurred up to that point must also be paid.

(3) In particular cases, a ban on future visits may also be imposed.

2.5. Hygiene Regulations

(1) Guests are required to maintain the highest standards of cleanliness throughout the thermal bath and spa. This includes wearing swimwear (except in the sauna areas) and suitable pool footwear.

(2) Swimwear must cover the genitals.

(3) Hygiene is also a primary consideration with regard to swimwear. In accordance with the applicable legal requirements, swimwear must therefore be water-repellent and non-absorbent. Swimsuits that meet these requirements may be worn when visiting the Therme Wien thermal bath and spa. For safety reasons, swimwear must be close-fitting and should not have any protruding parts that could increase the risk of becoming caught on projecting objects.

(4) Persons with infectious diseases must not visit the thermal bath and spa.

(5) Outdoor footwear must not be worn in barefoot areas. Foot-disinfection facilities should be used both when entering and when leaving the thermal bath and spa.

(6) For hygiene reasons, guests must shower before entering a pool each time. Showers must be turned off immediately after use.

(7) The use of soap, shampoo or detergents and the washing of swimwear in swimming pools or bathing pools is prohibited.

(8) Waste (bottles, cans, paper, etc.) must be placed in the waste containers provided.

(9) The consumption of food or alcoholic drinks brought onto the premises is prohibited.

(10) Where additional cleaning is required as a result of a guest’s actions, the guest responsible must pay a flat-rate charge of up to € 100.

2.6. Hazard and Safety Information

(1) Every guest is obliged to show consideration for other guests. Guests must therefore refrain from any behaviour that disturbs or endangers other guests. Bringing weapons (including any dangerous objects capable of being used to threaten life or physical safety) into the Therme Wien thermal bath and spa is prohibited.

(2) The boundaries and barriers of the thermal bath and spa premises must not be climbed on or climbed over.

(3) All facilities and equipment of the thermal bath and spa may only be used for their intended purpose (e.g. children’s paddling pools, non-swimmer areas, waterslides, etc.).

(4) Pools may only be entered using the designated means of access.

(5) Photographing and/or filming guests and/or employees without the appropriate consent of the persons concerned and the management is prohibited.

(6) Persons who are heavily intoxicated or visibly under the influence of other addictive or intoxicating substances may be refused admission and may be required to leave for the duration of their impairment.

(7) Indecent, immoral or offensive behaviour is strictly prohibited throughout the entire premises. In the event of a breach, the guest may be required to leave without any entitlement to a refund of the admission charge. In particular cases, the guest may also be banned from the premises and/or from future visits and the matter may be reported to the competent authority.

(8) Any damage, soiling or improper use of facilities, equipment or other property is prohibited. Any damage caused must be reported immediately by the guest. The thermal bath and spa resort reserves the right to claim reimbursement of costs, impose a ban from the premises and/or future visits and, where appropriate, report the matter to the competent authority.

2.7. Diving Area

(1) Diving is permitted only in the pools or parts of pools designated for this purpose and during the specified times.

(2) Diving may be restricted depending on the number of visitors.

(3) Divers must ensure that they do not endanger other guests.

(4) In the diving area, guests in the water must take particular care to ensure that diving activities do not endanger themselves or other guests. Swimmers and divers must show consideration for one another.

(5) In pools or parts of pools exclusively designated for diving, use by other guests during diving periods is permitted only to the extent that safe and unobstructed diving remains possible.

2.8. Use of Additional Facilities

(1) Sun loungers and deckchairs may be used free of charge while stocks last. Reserving them is, however, prohibited. A sufficiently large, clean bath towel must be used when using them.

(2) Towels may be hired for the applicable hire charge. Compensation must be paid in the event of loss or damage.

(3) Within the thermal bath and spa, guests must use the pushchairs provided free of charge by Therme Wien GmbH & Co KG.

2.9. Bringing in and Loss of Items, Parking of Vehicles

(1) Valuables must be deposited in the designated and appropriately marked security lockers. No liability is accepted for valuables brought into the thermal bath and spa and stored elsewhere.

(2) Found items must be handed in at the office of the thermal bath and spa against receipt.

(3) Vehicles or other objects may only be parked or placed in such a way that access to the thermal bath and spa is not obstructed, particularly with regard to access required for rescue services, the fire brigade or the police.

2.10. Duty to Report and Provide Assistance

(1) Accidents, thefts and complaints must be reported immediately to the responsible staff or to the management of the thermal bath and spa.

(2) Every guest is obliged to provide any necessary first aid or other assistance.

2.11. Other Provisions

(1) Smoking is prohibited throughout all indoor areas of the Therme Wien thermal bath and spa and in designated outdoor areas.

(2) Any form of commercial activity or advertising within the thermal bath and spa is prohibited without the consent of Therme Wien GmbH & Co KG.

(3) Pools may only be entered using the designated means of access.
